Terms of Service

These Terms govern the relationship between you and famagic UG (haftungsbeschränkt) for the use of the app and all connected services. We keep them as short and understandable as possible.

01Scope of Application

  1. These Terms of Service ("Terms") apply to all contracts between famagic UG (haftungsbeschränkt), Kuckhoffstr 31, 13156 Berlin ("famagic", "we") and users ("you") regarding the use of the famagic app and all connected websites and services.
  2. You use famagic as a consumer within the meaning of § 13 BGB (German Civil Code) for private family organization — not for commercial purposes.
  3. Deviating terms apply only if we expressly agree to them in writing.

02Conclusion of Contract

  1. By registering a famagic account with an email address and a password, a free usage contract ("Basic account") is concluded.
  2. famagic is currently free to use in full. There is at present no paid offering, no checkout process and no payment processing in the app.
  3. We may introduce paid additional features in the future. Should that happen, we will announce it in good time beforehand and clearly state the price, term and scope of services before any purchase. A paid contract is only concluded through your express consent. Without that consent your use remains free of charge as before — no costs arise for you and your account is not restricted.

03Scope of Services

famagic provides you and your family with a software-as-a-service platform for organizing everyday life together. This includes in particular:

  • Family calendar with shared events and reminder logic
  • Shared shopping and task lists with real-time sync
  • AI-powered meal planner and recipe collection
  • famCount for splitting family expenses fairly
  • Playdates with befriended families and an overview of items lent and borrowed
  • Inbox and family chat: AI-assisted analysis of photographed notes and of questions about family life

All of the modules listed above are currently available to you at no additional cost. You can see which features your account includes at any time in the app.

Availability. We aim for a permanently available, stable app and announce planned maintenance windows in advance where possible. As famagic is at an early stage, individual features may be temporarily unavailable or subject to change.

04Termination, Withdrawal & Refunds

Ending your use

Because use is free of charge, you can end it at any time and without notice: delete your account in the app or write to us at E-Mail. No costs arise from this.

Right of withdrawal

For paid contracts, you as a consumer have the statutory right of withdrawal of 14 days from conclusion of the contract. As long as famagic is free of charge, no such contract exists and there is therefore nothing to withdraw from. As soon as we offer paid features, you will receive a separate withdrawal notice before any purchase. Send any such declaration to E-Mail.

05User Obligations

  1. You ensure that your registration details are current and accurate.
  2. You keep your login credentials safe and do not share them with third parties outside your family.
  3. You agree not to misuse the service — no spam content, no automated requests, no circumvention of technical security measures.
  4. Children under 16 may use famagic only with the consent of a parent or legal guardian; standalone logins for children under 16 are not provided.

06User Content

  1. Content you create in famagic (lists, events, notes, recipes) remains entirely your own.
  2. You grant famagic only the rights necessary for the technical provision of the service (storage, display, synchronization across your devices and within your family).
  3. Your content is not used for advertising, model training, or sharing with third parties — see also our Privacy Policy.

07Liability

  1. For slightly negligent breaches of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical for this type of contract.
  2. Beyond that, liability is excluded to the extent permitted by law — in particular for the content of AI suggestions (meal plans, recipes): these are aids for orientation and do not replace medical, nutritional, or legal advice.

08Changes to These Terms

We may amend these Terms if legal requirements or features change. We announce material changes at least 30 days before they take effect, by email or in the app. If you do not object within the deadline, the amended Terms are deemed accepted. Your right to terminate without notice remains unaffected. Introducing a charge for using the service never takes effect by this route — it always requires your express consent.

09Final Provisions

  1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country of your habitual residence remain unaffected.
  2. The place of jurisdiction is Berlin.
  3. Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected.
